Job Description:
As Legal Counsel at Excent, you will be responsible for overseeing legal matters related to our P2P lending platform, payment services and fintech operations. You will collaborate with various internal stakeholders and external partners to ensure that our operations align with regulatory requirements and industry best practices.
Responsibilities:
- Legal Compliance: Monitor and ensure compliance with applicable laws, regulations and industry standards in the fintech and payment sectors.
- Contract Review: Review, draft, and negotiate contracts, agreements and terms of service with partners, vendors and customers.
- Regulatory Analysis: Stay updated on regulatory changes and assess their impact on the company’s operations, providing recommendations for compliance.
- Data Privacy: Manage data privacy and security compliance, including GDPR and other relevant data protection regulations.
- Risk Management: Identify and mitigate legal risks associated with P2P lending, payments and fintech operations.
- Legal Documentation: Prepare legal documentation, including loan agreements, terms of use and other legal documents.
- Litigation Support: Coordinate with external counsel, if necessary, and provide support in litigation matters.
- Policy Development: Develop and implement company policies and procedures related to legal and compliance matters.
- Contract Governance: Oversee contract governance and management, ensuring contract terms are adhered to.
- Legal Training: Provide legal guidance and training to internal teams on legal and compliance matters.
Qualifications:
- Juris Doctor (JD) degree from an accredited law school and active membership in the bar association.
- Minimum of 5 years of experience as legal counsel or attorney in the fintech, P2P lending or payment industry.
- Expertise in P2P lending regulations, payment processing and fintech legal frameworks.
- Strong understanding of data privacy and cybersecurity laws, including GDPR.
- Excellent contract negotiation and drafting skills.
- Knowledge of anti-money laundering (AML) and know your customer (KYC) compliance.
- Strong analytical and problem-solving skills with a keen attention to detail.
- Effective communication and interpersonal skills to work with cross-functional teams.
- Ability to adapt to a fast-paced and evolving fintech environment.
